Answering some common questions

Not yet. Florida’s Building Code (FBC §908.8) does require every new or replacement cooling tower to run at ≥ 8 cycles of concentration and file an annual affidavit with the local water provider—but it stops short of mandating Legionella cultures. Instead, owners are “expected” to manage risk through an ASHRAE 188 Water-Management Plan (WMP). 

Local best practice has settled on quarterly Legionella cultures for each cooling-tower basin and semi-annual tests on domestic hot-water loops. That cadence mirrors CDC’s cooling-tower toolkit and keeps insurers happy.

ASHRAE 188 is the industry standard that maps out who, what, where, and how you’ll control Legionella in every water system on site. CDC calls it “an industry standard for large buildings in the United States.” In practice, lenders and brand-standard audits now treat a written WMP as table stakes—even though state law hasn’t caught up yet.

Yes—Senate Bill 1190 (and newer drafts) would create a statewide cooling-tower registry, monthly Legionella sampling, and stiff fines for owners who skip paperwork. The bill has NOT passed as of July 2025, but its return in the next session is widely expected. Smart managers are “pre-compliant” today.

1) Annual Cooling-Tower Affidavit confirming ≥ 8 cycles (FBC §908.8). 2) Water-Management-Plan documentation you’ll show during health-department or insurance audits. Keep lab reports for at least five years—they prove you’re acting on test data. 

Carriers learned the hard way that a single outbreak can cost more than a slip-and-fall portfolio. Many now add “Show us your quarterly cultures and WMP” riders at renewal. Routine sampling plus a written plan can shave 5-10 % off environmental-liability premiums
